Appeals & Post-Conviction

A trial is not always the end of a case. We handle criminal and civil appeals, and motions to vacate convictions and reduce sentences, in state and federal courts.

Appeals

Mr. Horowitz has briefed and argued appeals in the United States Court of Appeals for the Second Circuit and in New York State appellate courts.

In an Internet defamation matter, he identified the lower court's misapplication of First Amendment principles and persuaded the Appellate Division, First Department to reverse and dismiss all of the plaintiffs' claims.

In a trade secrets and non-competition case, he obtained reversal of the trial court's summary judgment order at the Appellate Division, Second Department, and then secured a favorable resolution at trial before the close of evidence.

Effective appellate advocacy demands mastery of the record and a clear, compelling argument on the law. We handle the full range of factual and legal issues on appeal, and we are especially effective when an appeal turns on technical evidence, where few appellate lawyers can explain a complex record with the same precision.

Post-Conviction Motions

Post-conviction motions often turn on technical evidence, and the legal arguments bound up with it, that were not fully challenged at trial. Our expertise allows us to identify those issues and develop them into compelling claims, including claims of ineffective assistance of counsel.

Motions to vacate

Federal motions under 28 U.S.C. § 2255 and New York motions under CPL § 440 to vacate a conviction or sentence.

Compassionate release

Motions under 18 U.S.C. § 3582(c)(1)(A) for clients with extraordinary and compelling circumstances.

Sentence reductions

Motions based on changes to the Sentencing Guidelines and other grounds for reducing a sentence.
